Technically, I would have to say it's not.
The panelist made a bad judgment call on similarity and should have properly considered the fact that the respondent's name is WindWorks, and they operate in Texas, hence prefixing or suffixing "Texas" is completely fair and legitimate.
But the even bigger question is why did WindWorks go with
TexasWindWorks.com
over
WindWorksTexas.com
? Wouldn't that domain make a better choice?
