• 06:30 am 12-Jul-2011 Although not expressly stated, it seems this case really turned on the geographic scope of Complainant's pre-registration, common-law trademark rights. Since Respondent also started its business in 2001, in a geographically remote location, it may not have known of Complainant in Texas and its own business in California supports a legitimate right to use the Chirospa mark and domain.
